2. Definitions & Interpretation

- “Company,” “We,” “Us,” “Our”: AdvenTurous Five (ABN:19651643695).
- “Client,” “You,” “Guest”: The person making the booking and all persons traveling under that booking.
- “Tour” or “Services”: The travel and recreational services provided by the Company.
3. Booking and Payment
- Contract Formation: When and how a booking is confirmed (e.g., upon receipt of full payment/deposit and confirmation email).
- Pricing: All prices are in AUD and include GST unless stated otherwise. Prices are subject to change until confirmed by booking.
- Deposit/Full Payment: Specify deposit requirements, due dates, and when the final balance is due.
- Payment Methods: List accepted methods.
4. Cancellation and Refunds
This is the most critical section for a tour company. Clearly define who makes the cancellation and the financial consequences.
A. Cancellation by the Client (You)
- Cancellation Fees: Implement a clear tiered structure (e.g.):
- 30+ days prior to departure: Full refund less an administrative fee.
- 7-29 days prior: 50% refund.
- Less than 7 days prior / No show: 0% refund.
- How to Cancel: Must be in writing (email).
B. Cancellation or Amendment by the Company (Us)
- Force Majeure/External Factors: State that AdvenTurous Five is not liable for cancellations due to extreme weather, safety concerns, political unrest, or events outside its control (e.g., road closures). In such cases, offer a re-booking, credit, or partial/full refund based on irrecoverable costs.
- Minimum Numbers: State the right to cancel if minimum passenger numbers are not met (typically 7-14 days before departure). Offer a full refund or alternative date.
5. Health, Fitness, and Participation
- Medical Conditions: Requirement for clients to disclose any medical conditions or mobility issues before booking.
- Physical Fitness: A general statement that tours require a basic level of fitness (refer back to the specific tour page for details).
- Right to Refuse: The Company reserves the right to refuse participation to any individual deemed unfit, disruptive, or a risk to safety (without refund).
6. Liability and Safety
- Australian Consumer Law (ACL): Explicitly acknowledge that these T&Cs do not exclude, restrict, or modify any rights or remedies you may have under the ACL. Services will be provided with due care and skill.
- Client Responsibility: Clients are responsible for their own property and conduct.
- Third-Party Suppliers: If you use third-party operators (e.g., helicopter rides, ferry services), state that you act as an agent and are not responsible for their acts or omissions.
- Safety Instructions: Clients must follow all instructions given by the guide/driver.
7. Travel Insurance (Mandatory/Recommended)
- Recommendation: Strongly recommend that all guests purchase comprehensive travel insurance covering cancellation, loss of luggage, medical expenses, and potential tour disruptions. For multi-day tours, this may be stated as mandatory.
8. Privacy
